Our Client was employed under a multimillion-pound subcontract agreement with a Main Contractor on a large housing development. Our Clients contract was terminated by the Main Contractor. On behalf of our Client, we challenged the validity of the termination. A dispute arose between both parties, with our Client claiming that the Main Contractor was in repudiatory breach.
We were instructed to refer the dispute to adjudication to seek a decision on the validity of the termination and an award for damages for the repudiatory breach.
Our client was awarded £3.25 million
The adjudicator affirmed Arbicon’s view that the termination was invalid and awarded substantial sums for damages.
