Arbicon were instructed by IBB Law LLP to prepare an Expert Report on a Delay Analysis and Loss & Expense claim for its residential client, in preparation of a defence to a contractor’s referral in adjudication.

The contract works related to an extensive new basement and garden cottage development at the existing residential dwelling. The construction project fell into delay, disputes arose concerning the value of works and the contractor’s works were terminated by the Employer with works remaining to be completed.

The contractor referred to adjudication concerning claims for monies allegedly owed under the contract up to the termination.

Solution

Arbicon successfully assisted IBB Law LLP and the client’s team in defending the adjudicated claim seeking payment of £890,000, including a claim by the contractor for an extension of time and loss & expense. The adjudicator only awarding the contractor £12,000+VAT (less than 2% of the sum claimed.

The residential client thanked and congratulated the team on achieving the result over the very short timeframe expended to ensure success.
